1. Agreement to Terms

By accessing or using CrazyBite's website, mobile application, or any related services (the "Service"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you must not use the Service. Your continued use constitutes acceptance of any future changes we publish.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements.

3. User Account

To place orders, make table reservations, or use certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your password and account.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are fraudulent or abusive.

4. Ordering and Payment

• Orders: All orders are subject to acceptance by the restaurant and availability. We act as an intermediary between you and the restaurant; the contract for food is between you and the restaurant.
• Prices: Prices displayed in the app or on the website are as quoted at the time of order. Taxes, delivery fees, and any applicable charges will be shown before you confirm payment.
• Payment: Payment must be made at the time of ordering (online) or upon delivery when cash on delivery (COD) is available. We accept payment methods as displayed in the app (e.g. cards, digital wallets, COD).
• Errors: We strive to display accurate information but do not warrant that menu descriptions, pricing, or availability are error-free. We reserve the right to correct errors and cancel orders arising from such errors.

5. Table Reservations

Table booking through CrazyBite is subject to restaurant availability and the restaurant's own policies. We do not guarantee availability. You agree to arrive on time and to cancel or modify reservations through the app when your plans change. Repeated no-shows may result in restrictions on future bookings.

6. Delivery

We aim to deliver within the estimated time shown. Delivery times are estimates only and not guaranteed. We are not liable for delays caused by traffic, weather, restaurant preparation time, or other circumstances beyond our reasonable control. You are responsible for providing a correct and accessible delivery address and for being available to receive the order at the given time.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe the rights of others (including intellectual property or privacy).
• Transmit harmful, offensive, or fraudulent content or engage in harassment.
• Attempt to gain unauthorized access to our systems, other users' accounts, or third-party systems.
• Use the Service for any commercial resale or unauthorized purpose.
• Interfere with or disrupt the Service or the servers or networks connected to it.

We may suspend or terminate your access for breach of these rules.

8. Intellectual Property

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, icons, and software) are owned by CrazyBite or its licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for the quality, safety, or legality of food prepared by restaurants or for the conduct of delivery partners or third parties.

10. Limitation of Liability

To the maximum extent permitted by law, CrazyBite (and its affiliates, officers, and employees) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred (100) units of your local currency, whichever is greater. Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless CrazyBite and its affiliates, officers, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of another party.

12. Refunds and Cancellations

Refund and cancellation rules are set out in our Refund & Cancellation Policy. By using the Service, you agree to those terms as well.

13. Governing Law and Disputes

These terms are governed by the laws of the jurisdiction in which CrazyBite operates (as stated on the Service), without regard to conflict of law principles. Any dispute arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, except where prohibited. You may also have rights under consumer protection laws in your country that cannot be excluded by contract.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the updated terms on this page and update the "Last Updated" date. For material changes, we may notify you via email or in-app notification. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised terms. If you do not agree, you must stop using the Service.

15. Severability and Waiver

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
